A – General remarks

  1. StarVegas.ch is a Swiss online casino operated by Casino Interlaken AG, Strandbadstrasse 44, 3800 Interlaken, via the website www.starvegas.ch and mobile applications (collectively: StarVegas.ch) on the basis of concession no. 516-010-01 issued by the Swiss Federal Gaming Board (ESBK). Casino Interlaken AG is monitored by the ESBK.
  2. These Terms and Conditions (T&Cs) apply to the content and services provided on StarVegas.ch, including deposits and payouts, as well as to the content sent or uploaded, such as images, by players via the resources available such as chat, email or SMS (“Participatory Content”). 
  3. The T&Cs govern the use of the content and services provided on StarVegas.ch to which you as a player or interested visitor have access. Before you use StarVegas.ch, you must agree to these T&Cs. Your consent to the T&Cs creates a legally binding agreement between you and StarVegas.ch. You consent to the T&Cs by registering with StarVegas.ch and/or using services that are provided on StarVegas.ch. By consenting to the T&Cs you acknowledge and confirm the latter, their validity with immediate effect and accept them for the duration of your use of the website.
  4. The following documents and regulations constitute an integral part of these T&Cs. By consenting to these T&Cs, you confirm that you also understand, accept and acknowledge the following:
    1. Privacy notice and cookie policy;
    2. Rules of the games – as stated in the games;
    3. Promotion and bonus conditions;
    4. Responsible Gaming.

B – Description of the services

  1. You can take part in all the betting games available on StarVegas.ch by using sums of money. You can access StarVegas.ch using desktop devices and, if applicable, using mobile telephones and tablets. The mobile version of StarVegas.ch may not support all the functions of the desktop version.
  2. StarVegas.ch reserves the right, from time to time, to extend and change the number and type of services offered on StarVegas.ch, or to cancel any of them, based on the company’s requirements and/or statutory requirements; StarVegas.ch is not obliged to notify you personally of this or to obtain your consent.
  3. The games provided on StarVegas.ch are based on state-of-the-art technology. However, StarVegas.ch does not guarantee the interruption-free availability and complete functionality of all games and services. StarVegas.ch undertakes all reasonable efforts to rectify identified errors that may occur. 
  4. Services that are not provided by StarVegas.ch are not the object of these T&Cs, for example the Internet connection, the software provided by third parties (such as PC operating systems, access software, web browsers, app stores) or your own hardware (PC, tablet, mobile telephone etc.).
  5. You are yourself solely responsible for the technical configuration of your computer, mobile telephone, tablet or other devices on which you access StarVegas.ch. More detailed information regarding the recommended configuration is available in the FAQ area on StarVegas.ch.

C – Registration and participation in the games

  1. In order to take part in the games provided on StarVegas.ch, you must have successfully registered on StarVegas.ch, whereupon StarVegas.ch will open your account. It is free of charge to register. StarVegas.ch is entitled to refuse to open an account without indicating its reasons for doing so.
  2. To successfully register on StarVegas.ch, you must have (a) reached the age of 18 and (b) have your domicile or usual place of residence in Switzerland. If not, you may be either blocked or banned from playing. You may also be excluded from StarVegas.ch for other reasons, in particular in connection with breaching the provisions of these T&Cs. Legal entities are not allowed to register.
  3. You are not permitted to open and maintain more than one account on StarVegas.ch. If StarVegas.ch suspects that several accounts belong to the same player, we reserve the right to block the accounts in question until the necessary checks have been carried out.
  4. To open an account, you must provide StarVegas.ch with all the following personal information:
  • First name;
  • Surname;
  • Date of birth;
  • Gender; 
  • Nationality;
  • Address of your domicile or usual place of residence; 
  • Telephone number;
  • Email address.
  1. This and all other information that you provide to StarVegas.ch must be truthful and correct. 
  2. After you have registered on StarVegas.ch, the personal data you have provided will be processed in accordance with the statutory provisions and StarVegas.ch’s privacy notice. In particular, StarVegas.ch is entitled and legally obliged to check whether, on the basis of the information you have provided, you are subject to a gaming block or ban.
  3. After the provision of your data, you must create your own username that is unique and clearly identifiable, which for security reasons must not be the same as your first name and surname. You have no claim to a specific username selected by you. You are not allowed to use usernames that are offensive, obscene, indecent or prohibited by law. In addition, you are not permitted to use any username that contains an Internet link or suggests one, or names that refer to certain rights of the user, such as “administrator”, “operator” or similar. StarVegas.ch reserves the right, at its own discretion, to close and/or temporarily or permanently block accounts that use unacceptable usernames. StarVegas.ch will reactivate the blocked accounts only after the username has been successfully changed to one that is acceptable to StarVegas.ch.
  4. To complete your registration, you will also be asked to create a password for your login in addition to your username. We recommend that (a) the password is not written down where it is easily accessible by third parties, (b) you do not use easy to guess passwords such as dates of birth, telephone numbers, number plate details etc. and (c) you create secure passwords that contain different types of characters, such as upper-case and lower-case letters, numbers and special characters (such as /?&*). You are solely and independently responsible for ensuring that your username and password are not disclosed to third parties and that this information is stored safely at all times and under all circumstances. StarVegas.ch is entitled to block any account temporarily and/or close any account should there be justified reasons to suspect that the security of the account is compromised in any way. In such cases, existing credit balances may be transferred to the player’s payment account using the procedures set out in Section (E) regarding payouts. The player is recommended to change the password as a matter of urgently should the player believe that the security of its account information could be compromised. According to tried-and-tested security practices, the player should change the password on a regular basis. The player must notify us immediately if they suspect unauthorised use of the account or access to the password. The player has no legal claim to a specific password. Furthermore, you must determine the scope of your personal limits (deposit limit, loss limit) as well as their duration and amount.
  5. After your account has been created and verified by StarVegas.ch, we will send a confirmation by email to the email address you have indicated. After the email address has been confirmed by you, you can deposit into your account sums of money to be used for betting for money in accordance with the other provisions of these T&Cs. 
  6. You are solely and independently responsible for ensuring that, after logging in, third parties cannot access your account. That’s why devices on which you have logged into your account, such as desktop PCs, tablets or mobile telephones should not be left unattended or passed to third parties. StarVegas.ch accepts no liability for losses or damages that you incur as a result of third parties using our services. 
  7. By opening an account on StarVegas.ch, you confirm and affirm that you:
  1. Are at least 18 years old;
  2. Are not covered by either a gaming ban or a gaming block;
  3. Have the mental capability to bear responsibility for your own actions and to enter into a legally binding agreement with StarVegas.ch;
  4. Have provided personal data that is correct, accurate and complete in every respect and will notify StarVegas.ch in writing immediately of any changes to this information and submit upon request all the necessary identification documents;
  5. Will act on your own behalf and for your own account when using the offerings provided by StarVegas.ch;
  6. Have understood that you may lose money by accessing StarVegas.ch and using the betting games available on StarVegas.ch, and that you are solely responsible for these losses. You absolve StarVegas.ch from any liability in this respect;
  7. At the time of registration, have no active account on StarVegas.ch and also have not previously held an account that was blocked or closed due to breaches of the T&Cs, are not the subject of any self-exclusions;
  8. Will not deposit any funds into the account that stem from criminal and/or other illegal activities;
  9. Are duly entitled to use on your own behalf a credit/debit card  as well as other payment methods available on StarVegas.ch in order to deposit money into an account;
  10. Will not deposit funds into the account for any reason other than for taking part in the betting games provided by StarVegas.ch;
  11. Will not use geolocalisation services in order to circumvent any foreign country exclusions set up by StarVegas.ch;
  12. Will not attempt to sell accounts to other players or otherwise take over accounts held by other players such as by means of transfer;
  13. Will not attempt to transfer funds via the accounts of other players;
  14. Will request payouts to a payment account in your own name only;
  15. Are not an employee or member of the Board of Administration of StarVegas.ch or Casino Interlaken AG or any other Swiss and Liechtenstein casino;
  16. Are not an employee of member of the management of Greentube I.E.S. GmbH;
  17. Are not an employee or member of the ESBK.
  1. In particular, the registration of a player by StarVegas.ch will be rejected if the player’s identity cannot be verified. Identification can be proven in the following ways::
  1. with an official identification document which features a photograph and on which all information is written using the Roman alphabet, such as a passport, ID card or driving licence; residence permits B, C, CI and L are also accepted;
  2. with a copy of an identification document detailed under point a. whose authenticity is verified in accordance with Article 6;
  3. with a copy of an identification document detailed under point a. and proof that the player holds a payment account in Switzerland under their own name;
  4. with an officially recognised electronic identification method;
  5. with a video or online identification method; or
  6. with any other equivalent method that has already been authorised by the ESBK (Swiss Federal Gaming Board)

    StarVegas.ch will verify your identity using the personal data you provided when registering on StarVegas.ch. This data will be checked in accordance with the General Terms & Conditions and applicable laws using duly authorised sources or databases of third-party providers (such as CRIF). This includes verification of your identity documents, your address and your payment account. Should you provide incorrect and/or incomplete personal data, you will be given the opportunity to correct this in order to complete the registration using the corresponding documents. Acceptance of these documents is at the sole discretion of StarVegas.ch. StarVegas.ch reserves the right to request that you submit further and additional specific documents in order to complete the identification procedure, such as a copy of a valid passport, identity card, driving licence or of proof of residence, telephone, internet or electricity bills, account statements, etc.
  1. By accepting the T&Cs and registering on StarVegas.ch, you consent to the forwarding of your personal data to an officially or privately administered database (such as CRIF) for the purpose of verifying your identity. You agree that the database will then report back to StarVegas.ch the result of your data reconciliation. The personal data passed by StarVegas.ch to the database will not be stored by the latter; only the fact that your address was checked will be stored. In addition, we would like to point out that payment records, in particular undisputed claims that have not been paid after the due date and, if applicable, debt collection information and address data, are transmitted to CRIF AG in Zürich for lawful use as a credit agency. CRIF will use the data to check your identity and creditworthiness and will disclose it to authorised third parties, among other things, for obtaining a debt enforcement register extract as part of fulfilling our legal duties.The payment records can be analyzed by CRIF using statistical calculation methods for automated decision-making, in particular for the assessment of a person's creditworthiness.
  2. You are obliged to at all times keep the data you provided at the time of registration up to date and to notify StarVegas.ch of any change to this data by promptly making yourself the corresponding changes to your account settings and/or by contacting customer services. StarVegas.ch reserves the right to carry out all the necessary checks on the changes you have made and to request the submission of all the documents regarded as necessary to verify the changes. If you do not notify StarVegas.ch of changes, the personal data last stored in your account will be regarded as valid and binding.

D – Deposits; administration of the player account

  1. To take advantage of the betting games offered and deposit funds, you must, after successful registration of your player account, make an initial deposit to your player account using one of the payment methods available on StarVegas.ch. The account will be operated in Swiss francs (CHF).
  2. The funds paid in by yourself must come from a legal source.
  3. Deposits can only be made after your account has been authorised and activated by StarVegas.ch for the transfer of funds using one of the payment methods provided by StarVegas.ch. You can make deposits via your personal bank account, using your debit/credit card or using your electronic wallet. StarVegas.ch does not guarantee all payment methods will always be available and reserves the right the occasionally change the payment methods accepted at its own discretion.
  4. Provisional player account: Based on the information you provided while registering (Para. 13), you can deposit a maximum of amount of CHF 1,000 into your account within 30 days. Before making larger deposits or being able to have winnings paid out, StarVegas.ch must receive from you and check the additional supporting documents stated in Para. 28 below. If they cannot be successfully checked within 30 days of registration, StarVegas.ch is obliged to close your provisional player account and reimburse you the amount that has not been used for gaming, whereupon you may not receive, due to statutory provisions, any winnings due to you. Any amount that has not been used for gaming can only be reimbursed if you send StarVegas.ch within 100 days of your registration a recent account statement of a bank or post office account or a similar account that is registered under your name («payment account»). If StarVegas.ch does not receive such an account statement within the allotted time, your provisional player account will be closed automatically and StarVegas.ch will be legally obliged to transfer any money remaining in your player account to the AHV compensation fund. 
  5. In order to continue using your player account without interruption and be able to have winnings paid out, you must submit the following to StarVegas.ch within 30 days of registration:
  1. A copy of your official identity document with photo (passport, ID, driving licence), either in electronic form or in paper form; and
  2. Proof of a deposit account in your name that you intend to use for deposits into your player account, be this directly or via a credit card or other payment systems. Proof would primarily be a current account statement from a bank or from a post account or a similar account;
  3. Proof of a payment account in your name to which StarVegas.ch will transfer your winnings and other credits. Generally, your deposit account and payment account should be the same;
  4. Other supporting documentation that may be required at the discretion of StarVegas.ch. 
  1. An amount is regarded as having been paid in as soon as your deposit has been irreversibly credited to the account in question. The period of time until an amount is credited to the account depends on the method of payment selected. The minimum deposit amount is CHF 10. StarVegas.ch reserves the right to adjust the deposit limits indicated at its own discretion or to carry out ongoing and repeated checks of the deposits.
  2. StarVegas.ch can specify standard monthly deposit limits for an account. The applicable deposit limits are displayed in the respective account. StarVegas.ch reserves the right to adjust, at any time and at its own discretion, the maximum monthly deposit limit.
  3. The sole purpose of the account is to enable your participation as a player. In particular, it may not be used to “park” money or to transfer money to third parties. The amounts deposited into the account should be used at least once in a game.
  4. All accounts and money transactions will be checked by StarVegas.ch to prevent money laundering and the financing of terrorism. Suspicious transactions can be reported by StarVegas.ch to the authorities responsible in accordance with the applicable legislation.
  5. Should StarVegas.ch credit an amount to an account by mistake, you are obliged to notify StarVegas.ch of this as soon as possible. StarVegas.ch is entitled to request the return of the amount credited by mistake. If an amount erroneously credited to the account has already been withdrawn by you, you are obliged, after receiving a corresponding request, to repay to StarVegas.ch the amount received by mistake. If you refuse to do so, you remain liable and StarVegas.ch is entitled to withhold subsequent winnings due to you in order to settle the claim.
  6. You are solely responsible for the fulfilment of any tax obligations in connection with winnings obtained on StarVegas.ch. StarVegas.ch is obliged by law, in the case of winnings exceeding CHF 1 (one) million, to retain withholding tax, which is currently 35%, and to pay this to the Swiss Federal Tax Administration. In this case you will receive from StarVegas.ch a withholding tax statement that you can use for your tax declarations to reclaim the withholding tax. The withholding tax is only due on that proportion of the winnings that exceeds the specified exemption limit of CHF 1 (one) million.
  7. StarVegas.ch administers the amounts paid into your account in trust as well as free of charge and on an interest-free basis for as long as the account is active. StarVegas.ch does not provide interest payments, loans or other services normally offered by financial institutions.
  8. Your balance will be administered in an independent StarVegas.ch bank account separate from all other accounts of Casino Interlaken AG. 

E – Payouts

  1. Winnings and other credits will be paid out at your express request by means of transfer to your payment account. The payouts will be processed by StarVegas.ch within 72 hours unless any further verification with respect to your identity or your payment account is required. StarVegas.ch reserves the right not to process payouts to credit cards and/or bank accounts that are not registered in your name. The payout sum requested must be at least CHF 10. Under no circumstances can payments be made to another player’s account or to third parties. A payout request cannot be made while a game is in progress. 
  2. StarVegas.ch undertakes careful checks with each payout request. StarVegas.ch is entitled, prior to any payout, to request additional supporting documents to verify your identity and that of the registered holder of the payment account, and also reserves the right to withhold the amounts until such adequate supporting documentation has been provided.
  3. If, as an exception, StarVegas.ch allows a payout to be made to a payment account other than the one used by you for deposits, the payout will only be made after completion by StarVegas.ch of all additional checks necessary. 
  4. If your payment account in your player account cannot be verified by StarVegas.ch or is no longer valid, StarVegas.ch shall inform you within five working days that you must provide the details of another valid payment account. You then have the option of providing the details for another valid payment account within twelve months. If you fail to do so, StarVegas.ch is entitled to retain the remaining credit. In accordance with statutory provisions, the credit must be transferred to the AHV compensation fund after a period of two years.
  5. StarVegas.ch complies in particular with the provisions and guidelines provided for the prevention of money laundering and the financing of terrorism. Suspicious transactions will be investigated by StarVegas.ch. In the case of suspicious transactions, StarVegas.ch can, as provided for in law, freeze, suspend or close the account in question and retain the funds therein.
  6. For amounts exceeding CHF 999, you have the option of cancelling your payout request before this has been approved for payout by StarVegas.ch. The cancellation applies to the full payout sum requested and is processed automatically. StarVegas.ch reserves the right to refuse your cancellation request at any time and at its own discretion. 
  7. The payout will be made as quickly as possible taking into account the payment method you have chosen.  

F – Games, conditions for winnings

  1. You acknowledge that the gaming elements of the games provided on StarVegas.ch are generated using a certified random number generator and are in no way influenced by StarVegas.ch. 
  2. StarVegas.ch reserves the right, at its own discretion and for any reason whatsoever, to refuse any player access to or participation in the games provided on StarVegas.ch and to limit or cancel deposits. Participation in games can also be subject to further restrictions; these are published on StarVegas.ch.
  3. Betting games will only be regarded as won if they have been played in accordance with the playing rules described on StarVegas.ch. While the game is underway, the player’s terminal must have a functioning connection to the game’s server. If the connection is interrupted during the game, a mechanism controls further participation in order to bring the game to an end properly and fairly. 
  4. If hardware or software faults influence the course of the game or the results, StarVegas.ch can and will suspend the payments, winnings and bonuses in question, analyse the faults and notify the players of the results of the analysis.  
  5. StarVegas.ch reserves the right to correct results retrospectively or declare them invalid if the game result was due a technical fault, a player’s unlawful behaviour or illegal deposits. Depending on the result of the correction, StarVegas.ch is entitled to credit or debit the player’s account with the amount to be corrected. If this correction leads to the account having a negative balance, the player is obliged to compensate for the difference by depositing the amount required to his player account or in some other way.
  6. Legitimately achieved winnings are credited to the winner’s player account. 
  7. If a player starts the round of a game and the connection to StarVegas.ch is subsequently lost, the result, regardless of whether this is a win or a loss, is assigned to the player’s account nevertheless. In the event of a connection loss during a game, the current round is terminated by clicking on the ”Play” or “Spin” button and the win/loss is credited to the player’s account  or deducted from the latter’s balance. After this round comes to an end, no further rounds will be played. If the player loses the connection during a free game, the average amount of winnings for this free game will be calculated and credited to the player’s account.
  8. If the player wants to complain that winnings obtained by him have not been credited to his player account, he must notify StarVegas.ch of this within ten days of the game in question by means of a letter or email. Any claims by the player are forfeited after this period.

G – Fees and reimbursement of costs

  1. It is free of charge to register and set up a player account
  2. Any costs incurred by StarVegas.ch in connection with justified reclaims or payments without a legal reason, such as due to the provision of an incorrect account number, that are the responsibility of the player, shall be paid by the latter. StarVegas.ch is entitled to request corresponding compensation from the player, such as for legal or collection fees. StarVegas.ch is entitled to deduct these costs from the player’s account and appoint a collections company, which can collect the amounts due at the cost of the player. 

H – Promotions and bonuses

  1. StarVegas.ch can decide, to the extent permitted by law and at its own discretion, to provide players with gaming promotions, loyalty programmes and/or other offers, which include so-called bonus funds, free spins and/or other forms of virtual and/or actual rewards. The bonus funds and/or possible winnings generated from these spins can be used for participating in games on StarVegas.ch.
  2. All promotions and/or offers are subject to specific terms and conditions that are made available to the players in advance on StarVegas.ch at periodic intervals and which the players may voluntarily accept. 
  3. If the player has accepted the specific terms and conditions, the bonus funds will be credited to their account. The bonus funds are indicated and displayed separate from any other balances in the account. The bonus funds can only be paid out after having been converted into money in accordance with the applicable terms and conditions of the respective promotion or the respective offer. If an account contains both funds and bonus funds, it is generally the case that the bonus funds will only be available to be used as deposits after the existing balance of actual funds has been used in its entirety.
  4. The player accepts that StarVegas.ch can withdraw the granting of bonus funds. Deposits made using bonus funds can also be withheld by StarVegas.ch if they are connected to an account that was blocked and/or closed by applying the provisions of these T&Cs. The player has no entitlement to promotions and offers, including possible winnings connected with these, if these have already expired.

I – Player protection

  1. StarVegas.ch offers various measures to protect its players from potential gaming risks: (a) temporary withdrawal from playing, (b) deposit and loss limits and (c) voluntary playing ban (self-exclusion). The temporary withdrawal from playing becomes active immediately and lasts for at least 24 hours and for a maximum of 6 months. A voluntary playing ban can only be lifted after a minimum of 3 months.
  2. If you would like to block your account, you can do so by making adjustments directly in your account settings, sending an email to support@starvegas.ch or by calling the hotline, quoting your username. You can also specify daily, weekly and monthly deposit limits in your account settings. Limit reductions take effect immediately. An increase of a deposit limit takes effect after a period of 24 hours. For reasons of responsible gaming, StarVegas.ch is entitled to reject requests to increase deposit limits.
  3. You can implement a self-exclusion by adjusting your account settings directly or by sending an email to support@starvegas.ch. In the latter case, put the words "self-block" in the subject line. Requests sent by email will be processed as quickly as possible, although StarVegas.ch accepts no liability if you use further sums for gaming until the processing of the request by the team responsible. The self-exclusion can be implemented for a period of at least 3 months and for an unlimited period of time. After the end of the self-exclusion period, you can unblock your account by contacting the support team. If you opt for self-exclusion for an unlimited period of time, your account will be closed after 24 months and the gaming agreement with StarVegas.ch will be terminated with immediate effect. In this case, however, you have the option of opening a new account after 24 months have expired. StarVegas.ch is entitled to reject your application to open a new account. All games that may not have ended at the time of your self-exclusion will be decided in the normal way and within the normal time periods and, if applicable, any winnings will be transferred to your payment account. Accounts blocked due to self-exclusion cannot be reactivated during the period of the self-exclusion.
  4. After the activation of the self-exclusion, you will no longer be able to access your account. You will not receive any marketing material during the self-exclusion period and StarVegas.ch can refuse, and will refuse, to accept any deposits or participation in games. Any credits that may remain in your account will be transferred to your active payment account within five days of the activation of the self-exclusion. This must be verified and approved in advance by StarVegas.ch, as described in the relevant provisions of these T&Cs. If a transfer to your payment account is not possible, we shall inform of this by email and/or over the telephone in order for you to provide details of a valid payment account within twelve months and to submit the correct documents required to confirm ownership. StarVegas.ch will send a monthly reminder to you by email within this twelve-month period. At the end of this period, StarVegas.ch reserves the right to retain the remaining credit and transfer it to the AHV compensation fund.
  5. By applying for self-exclusion, you confirm to StarVegas.ch that you will not in any way attempt to circumvent the self-exclusion. StarVegas.ch is neither responsible nor liable for any consequences or losses of any kind that you may incur by circumventing the self-exclusion. This also applies when gaming using another account and/or accounts that have been registered StarVegas.ch after the provision of fallacious or inaccurate information.
  6. StarVegas.ch keeps records of players who have requested a block, self-exclusion and/or a permanent closure of their accounts, and can forward this information to other agencies entitled to receive it if they have so requested in accordance with the applicable legislation.

J – Inactivity and closure of accounts

  1. In the event of long-term inactivity of your account – you have not logged into your account for a period of twelve consecutive months – an automatic payout attempt is made to the last used deposit account. If the payout is not possible, you will be contacted by email with a requested to provide valid account details. 
  2. If your account remains inactive for longer than 24 consecutive months, StarVegas.ch is entitled and legally obliged to close the account, retain the balances and transfer them to the AHV compensation fund. 

K – Intellectual property

  1. By registering and/or using any services provided on StarVegas.ch, you acknowledge that all content on StarVegas.ch is the sole intellectual property of Casino Interlaken AG. You may use the content and information available on StarVegas.ch for personal purposes only. Use of the intellectual property for any other purpose is prohibited.
  2. The website of StarVegas.ch may contain references to third-party rights. You must comply with such rights.
  3. StarVegas.ch receives all-exclusive and licence-free intellectual property rights to the game content (such as photos, questions, comments, text messages and the like) that you have provided to Casino Interlaken AG via StarVegas.ch. You have no claim to compensation of any kind.

L – Misconduct

  1. The purpose of StarVegas.ch is to entertain you. You are not allowed to use StarVegas.ch for occupational or commercial purposes.
  2. Generally speaking, you are not allowed to open or use a player account in breach of these T&Cs or statutory provisions.
  3. The following provisions in Section (L) define particular examples and consequences of misconduct that has not already been covered in other sections of these T&Cs.
  4. Should you not fulfil or no longer fulfil one of the requirements for participation (at least 18 years old, domicile of normal residence in Switzerland, no gaming block or gaming ban) and take part in a game nevertheless, StarVegas.ch will refund to you any active balance, although a maximum of your deposits, but will not pay out to you any winnings or other claims. 
  5. Should you have more than one player account on StarVegas.ch (such as one set up based on false information), StarVegas.ch is entitled to block all your accounts, refuse payment of any claims, cancel any bonus funds and terminate the business relationship with you. 
  6. You are not permitted to make arrangements with other players in order to participate in games together or in a coordinated manner. If arrangements of any kind are suspected, including those using a chat system or similar, StarVegas.ch is entitled to collect the winnings of all the players involved in an arrangement and credit these to players who have suffered as a result.
  7. You are not allowed to disrupt or manipulate the services of StarVegas.ch in any way, by means of the following actions or attempted actions for example:
    1. You may not decompile the software on StarVegas.ch (= procedure for back translating machine codes into human-readable programme codes) and you may not use any software that could damage the software used on StarVegas.ch for client-server communication.
    2. You may not use any software on StarVegas.ch that (1) enables the use of artificial intelligence, (2) enables arrangements between players or (3) is regarded by StarVegas.ch as designed for committing fraud or achieving an unfair advantage. StarVegas.ch can take measures to recognise and prevent the use of such software, including, if possible, the reading of programmes currently installed on a player’s terminal and/or the monitoring and investigation of player conduct for security reasons. If StarVegas.ch discovers that prohibited software is being used, StarVegas.ch reserves the right to block and/or close the account in question and retain any balance on this account.
    3. Banned disruption of manipulation of services provided by StarVegas.ch includes the following types of misconduct in particular:
  • The transfer of any type of virus or spam and the attempt to disrupt or interrupt in any way the computer systems, terminals and programmes of others;
  • The deliberate blocking of games or services provided on StarVegas.ch; 
  • Any attempt to influence the results of a game by manipulating the programme or by other improper means;
  • Deliberately causing or exploiting malfunctions or defects of StarVegas.ch to undermine the natural progression of the game.
  1. In the event of misconduct by a player as defined in these T&Cs or statutory provisions, including those to combat money laundering and the financing of terrorism, StarVegas.ch reserves the right to exclude the player with immediate effect from any further use of the services provided on StarVegas.ch and to unilaterally terminate the agreement concluded between the player and StarVegas.ch. StarVegas.ch is also entitled to suspend and terminate games in progress, to block the player’s account with or without prior notification and to retain the balance on the account and any unlawfully obtained payables until clarification of any misconduct by the player at the latter’s own expense.

M – Liability

  1. StarVegas.ch is only liable for direct losses that you incur through StarVegas.ch acting deliberately or with gross negligence. If the law permits, any further liability is excluded, in particular for slight negligence, for indirect losses, for consequential losses and or force majeure as defined in legal practice. 
  2. In addition, StarVegas.ch accepts no responsibility and no liability for direct or indirect consequences that arise for you through your direct use or misuse, or by the use or misuse by third parties, of the services provided by StarVegas.ch.
  3. StarVegas.ch provides its services in the form shown on StarVegas.ch and with no guarantees or undertakings with respect to marketability or suitability for specific purposes. StarVegas.ch expressly excludes all any responsibility and liability for the following to the maximum extent permitted by law: 
  • Damages or losses that were caused by faults of any type in the StarVegas.ch software;
  • The accuracy of the information services or statistical and interim results provided on StarVegas.ch;
  • Technical malfunctions, system failures, defects, delays, interruptions, manipulated or improper data transfers, loss or corruption of data;
  • Consequences of faults in communication connections, DDOS attacks, viruses or any other harmful technology that result for the player from using services provided by StarVegas.ch;
  • Losses that result from the transfer of information to StarVegas.ch.
  1. StarVegas.ch assumes no liability for the unavailability of the website and gaming offer, nor for faulty software and/or detected errors and any resulting damages. Furthermore, StarVegas.ch is not responsible for ensuring that the website, servers connected with it or the systems provided by third-parties are free from viruses or other harmful components that can cause damage to the player's hardware and/or software, and nor is it responsible for any damage resulting from the latter. Furthermore, StarVegas.ch reserves the right to interrupt the operation of the software on StarVegas.ch in order to rectify faults or remove viruses.
  2. StarVegas.ch is in no way responsible for losses of any nature, including lost earnings, suffered by the player due to a disconnection or through the use of unsuitable hardware, software and/or connection configurations.
  3. StarVegas.ch not responsible for data entry errors, data storage errors or data processing errors or for the content, completeness and accuracy of the data transferred, including the player’s personal data. In particular, StarVegas.ch reserves the right to rectify obvious errors during the storage and processing of results, such as errors relating to the identity of the player, deposits, winnings, odds etc.
  4. StarVegas.ch is not liable to a player either contractually, under the law of tort or in any other way for financial losses of any kind or for the loss of data, including personal data, suffered by the player in connection with the use of StarVegas.ch.
  5. Subject to the provisions above, the company’s maximum liability to a player is in any case limited to the amount deposited by the latter.
  6. You agree to indemnify StarVegas.ch and its associated companies, executive employees, directors, agents and employees and exempt them from any liability, all costs, expenses, claims, losses, damages or payables (including legal costs), regardless of whether these are foreseeable or not, that arise as a consequence of or in connection with the following:
  • Breach of these T&Cs by the player;
  • Unauthorised and unlawful use of StarVegas.ch and/or the account by the player.
  1. All amounts that fall due under these T&Cs shall be paid in full by the player without any offsetting, counterclaims, reductions or deductions, unless this concerns the deduction or withholding of taxes prescribed by law.

N – Termination

  1. StarVegas.ch and the player are entitled to terminate, at any time and with immediate effect, the gaming agreement entered into between them without having to give a reason.
  2. In particular, StarVegas.ch reserves the right to terminate the agreement if there are reasons to assume that you could have breached any of the provisions of these T&Cs.
  3. You can terminate the agreement with StarVegas.ch by sending an email, quoting your name and username, to the StarVegas.ch support team: support@starvegas.ch. The email address you use for this must be the one we have on record for you in your contact details. Upon receipt of such an email, StarVegas.ch will close your account as quickly as possible and will transfer to your payment account any balance on the account. The information on the official ID must correspond to the details stored for the account. The payment conditions in the respective provisions of these T&Cs apply to all payouts of balances. When terminating the agreement, the account will be closed permanently and StarVegas.ch will no longer provide you with any services.

O – Various provisions

  1. StarVegas.ch reserves the right to amend these T&Cs at any time.
  2. The players shall be notified of all amendments or additions to these T&Cs. This can be done by informing the players of the amendments or additions in a pop-up window and requesting they accept the updated T&Cs before they continue using StarVegas.ch. The players are required to keep up to date with the current version of the T&Cs on a regular basis as well as the documents the contents of which constitute integral components. 
  3. All notifications regarding T&Cs are regarded as having been delivered in a legally valid manner when they are provided via StarVegas.ch or are sent to the email address registered for the player at the time of the notification. 
  4. Should individual provisions of these T&Cs prove to be invalid, this does not affect the validity of the other provisions. Invalid provisions are to be replaced by legal provisions that come as close as possible objectively and commercially to the invalid provisions. This provision also applies analogously when closing contractual loopholes.
  5. The player may not sell or otherwise transfer his rights or obligations granted or incurred by him under this gaming agreement with StarVegas.ch or these T&Cs.
  6. StarVegas.ch is authorised to transfer to another company, partially or in full, the services of StarVegas.ch, as well as the rights and obligations arising from the gaming agreements with players, that has properly acquired these services, rights and obligations.
  7. Notifications and other correspondence sent to the postal or email address stored by the player in their account are regarded as having been personally delivered as soon as they can be proven to have been despatched, regardless of whether they are actually received or not.
  8. These T&Cs and the website StarVegas.ch are provided in German and, at the reasonable discretion of StarVegas.ch, in other languages as well. In the event of any disagreement, the German version takes precedence over versions in another language.
  9. These T&Cs are subject to Swiss law to the exclusion of the UN Convention on Contracts for the International sale of Goods (CISG). The exclusive court of jurisdiction for all legal disputes arising from or in connection with these T&Cs is Berne.
